These Terms of Service ("Terms") govern your access to and use of the website engsutra.com and the web application app.engsutra.com operated by Idea Associates ("EngSutra", "we", "us", or "our") (together, the "Platform").
By creating an account or using any part of the Platform, you agree to these Terms. Please read them together with our Privacy Policy and Cookie Policy. If you do not agree, do not use the Platform.
1. Eligibility and accounts
You must be at least 16 years old (or the age of majority in your jurisdiction) and able to enter into a binding agreement to use the Platform. You are responsible for the accuracy of the details you provide at registration and for keeping them up to date.
- You are responsible for all activity that takes place under your account.
- Keep your password confidential and notify us immediately of any unauthorised use.
- Accounts are personal to you and may not be shared, sold, or transferred.
2. Licence to use the Platform
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own professional or study purposes. All rights not expressly granted are reserved.
3. Subscriptions, pricing and payment
Free accounts include the usage limits shown on our pricing page. Paid plans are billed in advance, monthly or yearly, in Nepalese Rupees (NPR), and renew automatically until cancelled.
- Payments are processed by our payment providers (such as Khalti or eSewa). We do not store your full card or bank credentials.
- Prices may change with at least 30 days' notice; changes do not affect a term already paid for.
- Applicable taxes are added where required, and invoices are issued to the billing details you provide.
4. Cancellation and refunds
You may cancel a subscription at any time from your account settings and will keep access until the end of the paid period. Refund requests made within 7 days of a first purchase are reviewed on a case-by-case basis. Renewal charges are generally non-refundable.
5. Acceptable use
You agree not to misuse the Platform. In particular, you may not:
- Copy, scrape, republish, or redistribute MCQ content, e-books, rate data, or other Platform content.
- Share account credentials, or resell or sublicense access to the Platform.
- Attempt to disrupt, overload, reverse engineer, or gain unauthorised access to the Platform or its systems.
- Upload or transmit unlawful, infringing, defamatory, or harmful material.
- Use automated tools to extract data except where we expressly permit it.
6. User content
You retain ownership of the projects, BOQ data, calculations, and files you create or upload. You grant us a limited licence to host, store, and process that content solely to operate the Platform and provide the service to you. You are responsible for ensuring you have the rights to any content you upload.
7. Professional disclaimer
Calculators, BOQ outputs, rate data, code references, and exam material are provided as engineering aids and study resources.
Results depend on the inputs you supply and must be reviewed by a qualified engineer before being relied on for design, tender, costing, or construction. EngSutra is not a substitute for professional judgement, statutory approval, or the official published versions of codes and rate documents.
8. Intellectual property
The Platform, its software, question banks, e-books, compilations of code and rate data, branding, and design remain the property of EngSutra or its licensors and are protected by applicable intellectual property law. Nothing in these Terms transfers ownership of that material to you.
9. Service availability and changes
We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features, and will give reasonable notice of material changes that affect a paid plan. Scheduled maintenance may occasionally interrupt access.
10. Third-party services
The Platform relies on third-party services such as hosting, security, email delivery, and payment gateways, and may link to third-party websites. We are not responsible for the content, policies, or availability of those services, and their use is governed by their own terms.
11. Limitation of liability
To the maximum extent permitted by law, EngSutra is not liable for indirect, incidental, special, or consequential losses, or for loss of profit, data, goodwill, or business arising from your use of the Platform. Our total aggregate liability for any claim is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim.
12. Suspension and termination
We may suspend or terminate an account that breaches these Terms, creates a security or legal risk, or is used fraudulently. You may close your account at any time. On termination, your licence to use the Platform ends; provisions on intellectual property, disclaimers, liability, and governing law survive.
13. Governing law and disputes
These Terms are governed by the laws of Nepal, including the Electronic Transaction Act, 2063 (2008). The courts of Kathmandu have exclusive jurisdiction over any dispute arising from these Terms or your use of the Platform. We encourage you to contact us first so we can try to resolve the matter informally.
